A2 Fiber You Tube Video Contest Rules
Interested in 1 gigabit Internet speed with downloads 100 times faster than conventional broadband? Join our efforts to make Ann Arbor one of the few cities Google selects as pilot communities for its Google Fiber project. Enter the A2 Fiber Amplify Your Life YouTube Contest.

And all you have to do to enter is create a 30 – 90 second video that says why you think Ann Arbor should win Google Fiber. Be creative and tell us what could happen in Ann Arbor with super high speed internet. The most creative, thoughtful, and compelling videos will win the prizes. Once you record your video, simply upload it to the A2 Fiber You Tube Contest Group. It’s that easy to enter.

Eligibility
The A2Fiber YouTube Competition (“the Contest”) is open to everyone.  Participants under the age of seventeen (17) must have the permission of their parent or guardian.
Member of the A2fiber YouTube Contest Selection Committee, their immediate family (spouse, parents, siblings and children) and household members of each such Member are not eligible. The Contest is subject to all applicable federal, state, and local laws and regulations. Void where prohibited by law.
How to Enter
·       Create your video following the listed requirements and upload it to the A2fiber on YouTube.
·       Fill out and submit the online entry form.  (link to their form…probably need one as well)
There is no limit on the number of videos someone may submit.
Submission Requirements
    1.    Video must be 30 to 90 seconds in length.
    2.    Video must be QuickTime/MOV, WMV, MPEG or AVI and submitted to the A2fiber on YouTube.
    3.    Video may be no larger than 50 MB.
    4.    Obtain and forward with your Submission release forms for all of the people featured in your video.  A Standard Release form is available HERE.  Release forms may be submitted in pdf format.
    5.    By entering the Contest you agree to indemnify LA2M, the City of Ann Arbor, the University of Michigan and all related parties for any claim, demand, judgment, or other allegation arising from your possible violation of someone's trademark, copyright, or other legally protected interest in any way in your video.
    6.    Winning Entrants must be able to provide A2fiber with an original video file.

Content Restrictions

• Submissions must not contain material that violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights or that constitutes copyright infringement;
• Submissions must not contain brand names or trademarks other than the logo for LA2M or A2fiber, which entrant is authorized to use for the purposes of this Submission only;
• Submissions must not contain images or artwork not created by entrant;
• Submissions must not contain material that is inappropriate, indecent, obscene hateful, tortious, defamatory, slanderous or libelous.  Avoid profane language, violence, sex or personal attacks on individuals or organizations of any kind;
• Submission may not contain any endorsement, solicitation, commercial, or similar content advocating for or against candidates for office, political issues, or commercial products.
• Submissions must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age; and
• Submissions must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any jurisdiction where Submission is created.
• Submissions cannot have been submitted previously in a promotion of any kind or exhibited or displayed publicly through any means previously.

Winner Selection:
After the contest closes, videos will be judged to see if they present accurate information and comply with the requirements of the contest. Those videos that do not comply will be disqualified. All other videos will advance to round two where the videos will be rated by a panel of judges from A2fiber and LA2M based on message, accuracy, appropriateness of theme, creativity, and entertainment value.  The following criteria will be applied:

• Originality (25%)

• Creativity (25%)

• Passion (25%)

• Vision for Ann Arbor’s Future (25%)

A winner will be selected and notified by email on or about April 1, 2010.  In the case of a tie between two (2) or more Submissions, the Submission with the highest Quality score will be selected as the winner.

The Grand Prize winning video will be posted on the LA2M, A2fiber.com and the City of Ann Arbor website.

If the selected winner cannot be contacted, he/she forfeits the prize. Failure to comply with the above requirements, return of prize notification or prize as undeliverable or disqualification of a potential winner for any reason will result in forfeiture of prize and A2fiber, at its sole option, may award the prize to the second-highest ranked Submission. Acceptance of any prize shall constitute and signify winner’s agreement and consent that A2fiber may use the winner’s name, city, state, likeness, photo, Submission and/or prize information in connection with the Contest, worldwide, including the Internet, without limitation and without further payment or consideration, except where prohibited by law. Prizes will be fulfilled within two weeks after the conclusion of the Contest.

By receipt of any prize, winner agrees to release and hold harmless A2fiber from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest or receipt or use or misuse of any prize.
Official Rules

By completing the application and entering the Contest, you fully and unconditionally agree to and accept these Official Rules and the decisions of A2Fiber, which are final and binding in all matters related to the Contest.    Further you agree that A2Fiber may, in its sole discretion, remove and/or disqualify your Submission from the Contest if it believes, in its sole discretion, that your Submission fails to conform to the Official Rules.

The Contest begins on March 17, 2010 at 12:00 a.m. Eastern Time ("ET") and ends on April 2, 2010 at 1:00 p.m. ET (the "Contest Period"). Your video must be submitted between these times in order to be judged. Judging starts at  10  a.m.  ET on April 3, 2010 and ends at 11:59 a.m. on April 6, 2010.  The YouTube computer is the official time-keeping device for the Contest.
 

All Submissions will become the exclusive property of A2fiber, and none will be acknowledged or returned. Except for the prize awarded to the winner of the video contest, no other compensation in any manner will be paid to any entrant of the video contest for the submission to A2fiber or A2fiber's future use of the video in any manner. A2fiber shall have the right, in its sole discretion, to edit, modify, format or adapt and publish any or all of the Submissions, and may use them in any media for standard government-related and other non-commercial purposes with attribution entrant, ENTERING A SUBMISSION IN THIS CONTEST CONSTITUTES ENTRANT’S IRREVOCABLE ASSIGNMENT, CONVEYANCE AND TRANFERENCE TO A2FIBER ANY AND ALL RIGHT, TITLE AND INTEREST IN THE SUBMISSION INCLUDING, WITHOUT LIMITATION, ALL COPYRIGHTS. 

A2fiber is not responsible for lost, late, incomplete, invalid, un-intelligible, misdirected Submissions, which are disqualified. If you want to remove your video from the competition, you may do so by requesting A2fiber delete your video from its competition prior to the announcement of the winner on or about April 11, 2010.
 

Prizes are non-transferable and no substitution will be made unless A2fiber, in its sole discretion, determines otherwise. A2fiber reserves the rights to substitute a prize or prize component for one of equal or greater value should it become unavailable for any reason. Winner is responsible for all taxes and fees associated with prize receipt and/or use.
 

A2fiber reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond A2fiber’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by A2fiber in its sole discretion. A2fiber, in its sole discretion, reserves the right to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules.   Any attempt by any person to deliberately undermine the legitimate operation of the Contest shall be grounds for disqualification of a Submission.  A2fiber’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
 

By completing an Application and entering the Contest, entrant agrees that A2fiber is not responsible for: (1) any incorrect or inaccurate information, whether caused by entrant, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; (5) late, lost, undeliverable, damaged or stolen electronic mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use or misuse of any prize. A2fiber is not responsible for misdirected or undeliverable entries or for any technical problems, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. A2fiber is not responsible for any typographical/other error in entries, selection announcement or for any liability for damage to any computer system resulting from participation in, accessing or downloading information in connection with this Contest.
 

Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of Michigan (Southern Division) or the appropriate Michigan State Court located in Washtenaw County, Michigan; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and A2fiber in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Michigan without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Michigan.
 

Privacy
The personal information you submit on the entry form will only be used to contact you in the event you win the contest or if there is a question or issue regarding your video or its content. We will not disclose, give, sell, or transfer any personal information about you, unless required for law enforcement or by statute. As your video will be made available to the public, you should not include personal information about yourself or anyone else.   A2fiber is using YouTube to host the videos for this contest. You are subject to YouTube's use, privacy, cookie, and security provisions also. Those provisions can be viewed at http://www.youtube-nocookie.com/t/privacy.
